How to Serve the IRS
Updated: Sep 23
The first step in serving an IRS-related matter is identifying exactly who the governing rule or court order requires to receive the documents. The IRS, Department of the Treasury, United States Attorney, and Attorney General are not interchangeable recipients.
Next, assemble a complete service packet for each required recipient. Keep identical working copies, record the date each packet leaves your possession, and preserve every tracking number, receipt, delivery confirmation, and returned envelope.
If a rule requires certified or registered mail, use the specified service level rather than ordinary first-class mail. If personal service is required, use a qualified server for the relevant jurisdiction.
After delivery, compare the evidence received with the service requirement. A tracking screenshot alone may not satisfy every proof requirement, so retain the mailing receipt, signature record, server declaration, or other available evidence.
File any required proof or certificate promptly and keep a complete service file. If a recipient rejects, refuses, or returns the package, preserve the returned item and document what occurred before deciding the next step.
TOFG can coordinate this workflow, prepare organized service packets, track delivery, and assemble the returned record for the client.
