How to Serve Legal Papers on the Internal Revenue Service
Updated: Sep 23
Serving legal papers in an IRS-related matter begins with identifying the exact recipients required by the governing rule, statute, court order, or proceeding. The Internal Revenue Service, Department of the Treasury, United States Attorney, and Attorney General are distinct recipients.
For summons-related or other federal tax matters, do not assume that sending one copy to a local IRS office completes every required service step. The correct path depends on the proceeding and document being served.
Prepare a complete packet for each required recipient and preserve the service method used for each one. If certified or registered mail is required, use the specified mailing method and retain the original receipt and delivery evidence.
If personal service is required on an officer, employee, witness, or other individual, treat that service separately from agency or United States service.
After delivery, organize the tracking record, return receipt, signature record, server declaration, returned envelope, or other available evidence into one proof file.
TOFG can coordinate this process, track each recipient separately, and organize the final service record.
