Federal Officer & Employee Individual-Capacity Service
Updated: Sep 23
A federal officer or employee sued in an individual capacity can create a service structure different from an ordinary agency-only case.
Depending on the claim and governing rule, service may need to address the individual defendant as well as specified United States recipients. Treating agency notice as a substitute for personal service can create avoidable problems.
TOFG separates each recipient and service method into its own track so personal delivery, agency routing, United States Attorney service, Attorney General service, and proof records are not conflated.
Clients should provide the exact caption, defendant name, employing agency, capacity alleged, known address information, court, case number, and service deadline.
This service is logistical and administrative. TOFG does not decide whether individual-capacity service is legally sufficient in a particular case.
